Terms & Conditions
These Terms & Conditions ("Terms") govern access to and use of the Employee Management System ("EMS", "the Service"), provided by Disa Global ("we", "us", "our"). By registering a company workspace, making a payment, or otherwise using the Service, you ("Customer", "you") agree to be bound by these Terms.
1. The Service
EMS is a subscription-based employee management platform covering attendance, leave, employee records, device management and reporting for registered companies. Access is granted per the plan (Starter, Basic, or Premium) selected and paid for at sign-up.
2. Account Registration
You must provide accurate company and admin account details during registration. The person completing registration is deemed authorised to act on behalf of the company being registered and to accept these Terms on its behalf. You are responsible for maintaining the confidentiality of your admin login credentials and for all activity carried out under your account.
3. Subscription Plans & Billing
Plans are billed monthly at the rate shown on the pricing page at the time of purchase (Starter ₹299/month, Basic ₹999/month, Premium ₹2,499/month), unless a valid coupon code reduces the amount payable. Prices are inclusive of applicable taxes unless stated otherwise. We reserve the right to change plan pricing with reasonable notice; continued use of the Service after a price change constitutes acceptance of the new pricing for future billing cycles.
Each plan has an employee-count limit. You are responsible for monitoring your headcount and upgrading your plan if you exceed the limit of your current plan.
4. Payments
Payments are processed through Razorpay, a third-party payment gateway. We do not store your card, UPI, or netbanking credentials — these are handled directly by Razorpay under its own terms and PCI-DSS compliant infrastructure. By making a payment you also agree to Razorpay's applicable terms of use.
A company workspace is created only after payment has been successfully verified (or a valid coupon has been applied). Attempting to bypass payment verification is a violation of these Terms.
5. Cancellations & Refunds
Our cancellation and refund terms are described in full in our Refund & Cancellation Policy, which forms part of these Terms.
6. Acceptable Use
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorised access to accounts, data, or systems other than your own; (c) reverse-engineer, resell, or sublicense the Service without our written consent; or (d) upload data you do not have the right to store, including employee data collected without proper notice or consent under applicable law.
7. Data & Privacy
Our handling of personal data — yours and your employees' — is described in our Privacy Policy. As the company administrator, you are responsible for ensuring you have the necessary rights and consents to upload employee data into the Service.
8. Service Availability
We aim to keep the Service available at all times but do not guarantee uninterrupted access. Scheduled maintenance, third-party outages (including payment gateway or hosting outages), or force majeure events may cause temporary unavailability.
9. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from use of, or inability to use, the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the three (3) months preceding the claim.
10. Termination
We may suspend or terminate a workspace for non-payment, breach of these Terms, or unlawful use. You may cancel your subscription at any time as described in our Refund & Cancellation Policy.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified via the email associated with your admin account or a notice within the Service. Continued use after such notice constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of India, and any disputes will be subject to the exclusive jurisdiction of the courts of Kerala, India.
